"Mei Yi's Graphic Design" Trademark Opposition
ZYIP has filed an opposition against Guangdong Midea Group Co., Ltd. (hereinafter referred to as the "Opposer") against Zhongshan Dongfeng Weiyao Electrical Appliance Factory (hereinafter referred to as the "Respondent") regarding the trademark "MEIYI DE AND ITS FIGURE" which was preliminarily examined and published by the Trademark Office in the 737th issue of the Trademark Gazette, No. 1439480. The Respondent made a response within the prescribed time limit.
The main argument of the opponent: The opponent has obtained the exclusive rights to the trademark "Midea MD and graphic" for products such as rice cookers and electric heaters. The disputed trademark is similar to the opponent's trademark and the goods they are used for are the same. The opponent's trademark is a well-known trademark with high recognition nationwide. The registration and use of the disputed trademark will cause confusion among consumers regarding the source of the goods.
The Trademark Office finally accepted our opinion. According to Article 28 and Article 33 of the "Trademark Law of the People's Republic of China", the Trademark Office ruled that the grounds of the opponent were valid, and the trademark number 1439480 was not approved for registration.
