The General Rules of Civil Law of the People's Republic of China was passed in the Fifth Session of the Twelfth National People’s Congress by a huge majority of 2,782 votes, which will take effect upon October 1, 2017. From then on, China’ s civil law system will enter “an era of civil code”.
It is noteworthy that, for the implementation of realizing legalization of civil rights and completing property rights protection system required by the CPC Central Committee, the General Rules of Civil Law has explicitly specified that civil subjects are entitled to IP by law in the chapter of civil rights and made generalized stipulations on objects protected by IP to lead relevant separate laws for IP. Some experts say the stipulations on IP and other civil rights in the General Rules of Civil Law have highlighted respect for civil rights and strengthened protection for civil rights, providing basis for specific stipulations for civil rights in special civil and commercial laws.
