Recently, the China National Intellectual Property Administration issued the Notice on Printing and Distributing the Administrative Measures for Credit Evaluation of Patent Agency (for Trial Implementation). After the implementation of the Measures, patent agencies and patent agents still in the punishment period of being ordered to stop undertaking new patent agency business shall conduct credit scoring according to the rules prescribed by the Office. This method will be implemented on a trial basis starting from May 1, 2023.

According to the credit scoring index system and scoring rules of patent agencies and agents:

Agency for abnormal patent applications:

1. For those who are deemed to have acted as agents for abnormal patent applications and have not yet been punished, 0.5 points will be deducted for each application, with a maximum deduction of 20 points

2. 10 points will be deducted for those who act as an agent for abnormal patent applications reported by the China National Intellectual Property Administration, have a large number of agents, repeatedly act as agents and other serious circumstances, fail to make rectification in place and have not been punished

3. For those who are found to have acted as agents for overseas abnormal patent applications, 1 point will be deducted for each application, with a maximum deduction of 20 points; For those who cause significant international adverse effects and refuse to withdraw, a maximum deduction of 40 points will be made

The maximum deduction for the above three items is 40 points

The per capita agency volume of practicing agents is much higher than the normal level:

If the per capita agency volume of practicing agents is significantly higher than the normal level and cannot be justified, 15 points will be deducted at a time.
