Recently, the General Office of the Ministry of Education, the General Office of the Ministry of Science and Technology, the General Office of the Ministry of Industry and Information Technology, the General Office of the Ministry of Agriculture and Rural Affairs, the General Office of the National Health Commission, the General Office of the Chinese Academy of Sciences, the General Office of the China National Intellectual Property Administration, on matters related to accelerating the promotion and transformation of existing patents in colleges and research institutions mentioned that:


(10) Strengthen policy coordination. Various regions should comprehensively sort out and optimize the relevant regulations on patent conversion incentive policies, strengthen policy coordination and connection between different levels and departments. We should highlight the guidance of patent quality and conversion application, play a good role as the evaluation baton, take the benefits of patent conversion and the reserve layout of original basic patents as important standards for the evaluation index system of various levels and types of patents, and not directly use the number of patents as the main condition for enterprise qualification recognition and preferential policies.

The competent departments of intellectual property, education, science and technology, industry and informatization, agriculture and rural areas, health and health in all provinces, autonomous regions, municipalities directly under the Central Government and the Xinjiang Production and Construction Corps, the National High tech Zone Management Committee, subordinate colleges and universities, colleges and universities jointly built by ministries and provinces, units under the Chinese Academy of Sciences, and relevant units:


Since the issuance of the "Work Plan for Revitalizing Existing Patents in Universities and Research Institutions", various localities and relevant departments have extensively mobilized, carefully organized, and actively taken action, achieving significant results. To comprehensively promote the conversion and utilization of existing patents, the relevant matters are hereby notified as follows.


1、 Fully recognize the importance and urgency of shifting the focus of work

At present, the inventory of existing patents in universities and research institutions across the country has been basically completed, laying a solid foundation for the subsequent large-scale transformation and application. All regions should shift their focus from inventory of existing patents to revitalization as soon as possible, and fully enter a new stage of revitalization as the purpose and promotion of inventory. We should focus on the main line of patent industrialization, mobilize various forces and social resources, make full use of online and offline methods, innovate transformation methods, enrich transformation content, expand transformation areas, promote the landing and transformation of high-value patents in all aspects, at multiple levels and through multiple channels, fully release the market value of patents, continuously enhance industrial competitiveness, and shape new advantages and new driving forces for industrial development.


2、 Ensure a seamless connection between inventory and activation

Provinces that have completed all inventory tasks should urgently plan and promote comprehensive transformation work. Some provinces that have not yet completed the inventory task should increase their efforts in accordance with the work requirements of "inventory, promotion, and transformation at the same time", and use revitalization as the starting point to promote universities and research institutions to fully complete the inventory of existing patents. In the process of revitalizing existing patents, each province should simultaneously carry out spot checks and analysis of inventory quality, further investigate patents with unclear industrialization prospects, screen patents with high value and good conversion prospects, and improve the efficiency and success rate of matching and docking.


3、 Organize precise matching and docking activities

(1) Organize online matchmaking activities for enterprises. Provincial intellectual property bureaus should work together with relevant departments to mobilize various types of enterprises within their administrative regions, such as intellectual property advantage demonstration enterprises, specialized and new small and medium-sized enterprises, high-tech enterprises, state-owned enterprises, and enterprises registered with intellectual property protection centers, to register and log in to the university and research institution existing patent activation system (hereinafter referred to as the activation system), or jump to the activation system through the small and medium-sized enterprise patent industrialization system, and subscribe to the required patents in the convertible patent resource library. Enterprises can directly contact universities or research institutions to analyze and evaluate subscribed patents, and provide feedback on their needs or cooperation intentions in the activation system if they have the intention to transfer, license, or invest, as well as the need for technological improvement or industry university research cooperation. If enterprises have no demand or intention to cooperate with subscribed patents, they can evaluate the industrialization prospects from a professional perspective for reference by enterprises in need. Guide all levels and types of intellectual property public service institutions and market-oriented service institutions to log in to the activation system, screen high-value patents in the patent conversion resource library, and provide conversion docking services for both supply and demand sides.


(2) Strengthen the sharing of convertible patent data. Provincial intellectual property bureaus and relevant departments should make full use of existing public service platforms, obtain convertible patent data from universities and research institutions from the activation system according to demand, construct a patent conversion resource library for their own province or department in their respective fields, and conduct correlation analysis between convertible patent data and enterprise related information to achieve accurate push of profiles of supply and demand sides. Encourage industries such as agriculture, rural areas, health and hygiene, as well as industry chain leaders, to build patent transformation resource libraries and carry out promotion and docking between their own industries or industry chain enterprises, upstream and downstream related enterprises.


(3) Expand diversified docking channels. We need to strengthen departmental collaboration, fully leverage the platform role of "Intellectual Property Services for Thousands of Miles", "Thousand Schools and Ten Thousand Enterprises" collaborative innovation partnership action, "Hundred Parks, Hundred Schools and Ten Thousand Enterprises" innovation cooperation action, "Hundred Events and Ten Thousand Enterprises" large, medium and small enterprise integration and docking, "One Month One Chain" investment and financing docking activities, and organize and carry out various forms of patent conversion and docking activities. Strengthen guidance and regulation for exhibitions, high-value patent cultivation and transformation competitions, innovation and entrepreneurship competitions, and other activities to enhance the effectiveness of docking. In the conversion and docking activities, it is necessary to do a solid job in patent screening and evaluation, in-depth analysis and display, target audience organization, project roadshows, and docking follow-up services. Provinces with abundant resources of universities and research institutions should strengthen communication and cooperation with provinces with concentrated enterprises and strong demand, and organize cross regional patent conversion and docking activities. Guide universities and research institutions to select patents with strong practicality, wide application fields, and suitability for implementation in multiple regions, and conduct "one to many" open licensing to improve docking efficiency.


4、 Strengthening collaboration to form a joint force for patent conversion

(4) Strengthen the main responsibility of universities and research institutions for patent conversion. Universities and research institutions, as the primary responsible parties for the high-quality creation and transformation of patents, should further improve the research evaluation system guided by patent transformation and application, and encourage the production of more cutting-edge and disruptive innovative achievements with application prospects; Strengthen the classification and centralized management of patents, with conversion and application as the driving force, establish and improve a pre application evaluation system for patents with industrialization prospect analysis as the core, and cultivate more high-value patents that meet industry needs; Further refine the due diligence exemption and fault tolerance mechanism for patent conversion, explore the formation of operable regulations and processes, and relieve the concerns of relevant personnel engaged in conversion work; Thoroughly review internal management system policies and promptly adjust relevant regulations that are not conducive to improving patent quality and facilitating smooth conversion; Effectively leverage the role of internal intellectual property management departments, national university science and technology parks, technology transfer and transformation institutions, university intellectual property information service centers, and other platforms related to the transformation of scientific and technological achievements, integrate and optimize the functions of internal relevant institutions, establish a mechanism for distributing intellectual property benefits with equal rights and obligations among units, researchers, and technology transfer and transformation institutions, strengthen incentives for patent transformation, and form a working force to promote patent transformation.


(5) Strengthen the dominant position of enterprise patent industrialization. Demonstration enterprises with intellectual property advantages, specialized and innovative small and medium-sized enterprises, and high-tech enterprises are the main force of industrial innovation. We should focus on technological upgrading and industrial competition needs, and increase efforts to introduce patented technologies and industrialize them. Encourage local intellectual property management departments, industrial parks, etc. to establish a regular investigation and feedback mechanism for enterprise patent technology needs, and timely collect enterprise technology improvement needs and industry university research cooperation needs. Guide enterprises to closely cooperate with universities and research institutions, jointly refine scientific and technological issues, jointly cultivate high-value patents, and promote enterprise led integration of industry, academia, and research innovation based on industry demand. Make full use of policies related to the transformation of scientific and technological achievements, the upgrading of manufacturing technology, the construction of concept validation centers, and the cultivation of high-value patents to accelerate the implementation of patent transformation projects with strong enterprise transformation intentions and clear industrialization prospects, and cultivate the formation of new quality productivity.


(6) Organize and mobilize intellectual property public service agencies to actively participate in patent conversion work. Organize provincial-level and prefecture level intellectual property public service institutions, Technology and Innovation Support Centers (TISCs), National Intellectual Property Information Service Centers of universities, national and provincial-level intellectual property information public service outlets, intellectual property protection centers, patent navigation service bases, and other various levels of intellectual property public service institutions, fully leverage their resource advantages and service expertise, and provide inclusive public services such as policy consultation, information services, business guidance, and capacity training around patent conversion work. Guide industry associations to focus on the demand for patent transformation in key areas of the industry, gather advantageous resources in the industrial chain, and collaborate to promote patent industrialization. Encourage local industrial technology infrastructure public service platforms, concept validation centers, and pilot platforms to fully leverage their public service roles, accelerate the maturation and incubation of patent industrialization projects. Around the patent conversion projects of universities and research institutions, various regions should strengthen the full process cultivation and guidance of intellectual property public service institutions, form typical experience and practices, and promote them.


(7) Strengthen the role of intellectual property operation service institutions in providing transformation and docking services. Guide and leverage the fundamental and functional trading platforms of national intellectual property and scientific and technological achievement property trading institutions such as the China Technology Exchange, Shanghai Technology Exchange, and Shenzhen Stock Exchange, actively link various local operating platforms, trading institutions, financial institutions, and other resources, increase the integration of intellectual property supply and demand, evaluation and assessment, investment and financing services, and improve the comprehensive efficiency of patent transformation services. Guide regional and industrial intellectual property operation centers to establish themselves in their respective regions and industries, provide specialized and distinctive operational services, and promote the accelerated landing and transformation of patents with industrialization prospects.


(8) Guide market-oriented service institutions to actively participate in patent conversion work. Encourage various intellectual property marketization service institutions and technology transfer and transformation institutions to focus on patent transformation and application, providing various value-added services such as screening and evaluation, roadshow promotion, and transaction matching. Encourage banks and other financial institutions to facilitate intellectual property pledge financing channels, and connect and support high-value patent industrialization projects of enterprises. Give full play to the role of government guidance funds for the development of small and medium-sized enterprises and the transformation of scientific and technological achievements, effectively utilize investment and financing platforms such as regional equity markets, and meet the funding needs of enterprise patent industrialization through various channels. Encourage venture capital institutions to strengthen intellectual property due diligence and guidance, support hard tech startups with core patented technologies, and achieve high-quality innovative development.


5、 Job requirements

(9) Strengthen organizational implementation. Each region should strengthen its goal oriented and result oriented approach, and enhance the organization, implementation, supervision, and guidance of the revitalization of existing patents. We need to strengthen the refinement and implementation of incentive policies related to patent conversion, and effectively bridge the "last mile" of policy implementation. We should leverage the demonstration and driving role of pilot cities, counties, and parks for building a strong intellectual property country, as well as national intellectual property pilot demonstration universities and advantageous demonstration enterprises, to create a model for patent conversion. The China National Intellectual Property Administration will, in due course, formulate and issue guidelines on patent transformation and application and patent project roadshows for universities and scientific research institutions. Various regions should promote and interpret incentive policies and work guidelines related to patent conversion through new media, short videos, training courses, and other means, as well as promote relevant experiences.


(10) Strengthen policy coordination. Various regions should comprehensively sort out and optimize the relevant regulations on patent conversion incentive policies, strengthen policy coordination and connection between different levels and departments. (11) Carry out statistical monitoring. The China National Intellectual Property Administration will regularly report data such as the transformation and docking of existing patents, patent transfer licenses of universities and scientific research institutions, patent implementation rate and industrialization rate. Each province's intellectual property bureau should follow up and monitor the relevant work and conversion effectiveness of the province's cities, standardize patent trading behavior, guide universities, institutions, and enterprises to complete patent transfer registration and license filing procedures in a timely manner, and timely fill in and provide feedback on relevant information on the revitalization system and the national patent intensive product filing and recognition pilot platform.


(12) Publish typical cases. The China National Intellectual Property Administration will collect, select and publish typical cases of service patent transformation around the service mode and product innovation of intellectual property public service institutions and market-oriented service institutions in patent transformation and application, and continue to publish successful cases of patent industrialization in due time. All localities should summarize and refine effective experience in policy innovation, service initiatives, transformation models, etc., form a replicable model, and report to the Application Promotion Department of the China National Intellectual Property Administration in a timely manner.
