Shenzhen Zhongyi Patent and Trademark Office, acting on behalf of Guangdong Midea Group Co., Ltd. (the objector), raised an objection against Weierhao Electric Appliance Factory (the objected) which was preliminarily approved by the Trademark Office and published in the 737 Trademark Announcement No. 1439480. The objected shall make a reply within the statutory time limit.

The main reason of the objector: the objector has obtained the exclusive right to use the trademark "Midea MD and the figure" on the 11th-class rice cooker, electric heater and other goods. The composition of the challenged trademark is similar to that of the objector, and the goods used are the same. The trademark of the objector is a well-known trademark, which has high popularity in the country. The registration and use of the objected trademark will cause consumers to confuse the source of the goods.

The Trademark Office finally accepted our opinion. According to Article 28 and Article 33 of the Trademark Law of the People's Republic of China, the Trademark Office ruled that the reason of the objector was valid, and the No. 1439480 trademark was not approved for registration.
