In accordance with the provisions of the new "Determination Measures”, new high-tech enterprise should be in the high and new technology areas strongly supported by the state; continuous research and development and transformation of technical achievements, forming enterprise core independent intellectual property rights, and on this basis to carry out the production and business operation activities; A resident enterprise registered in China (excluding Hong Kong, Macao and Taiwan) for more than one year. Here are three meanings:

First, the research and development and production and operation activities carried out by enterprises must conform to the industrial and technical direction supported by the state, which belongs to the scope stipulated in the high-tech field of national key support;

Secondly, it has the capability of continuous independent research and development, and has the core independent intellectual property rights, which will become the necessary conditions for high-tech enterprises.

Thirdly, the main business of enterprises must be closely related to their own research and development and transformation activities of technological achievements.

Enterprises that meet the above characteristics and meet the corresponding criteria shall be deemed as high-tech enterprises. Without conducting research and development activities, enterprises engaged in the production and processing of high and new technology products cannot be identified as high-tech enterprises.
