How long will the reexamination be requested after the patent application has been rejected?

The patent reexamination procedure is a remedy for the applicant when the patent application is rejected. According to article 41 of the patent law, the patent reexamination board shall accept and review the request for review and make a decision. The case for a reexamination request includes a case that the rejection of patent application decisions is unsatisfactory in the preliminary examination and the substantive review proceedings. Only the patent applicant has the right to start the patent reexamination procedure, and the patent reexamination board shall be submitted to the state intellectual property office within 3 months after receiving the notice of rejection.
